A border clearance agent may be a natural or legal person. The agent is appointed to carry out activities and formalities required by law before customs authorities. The representative’s affiliation with the customer shall be registered in the PUESC, through individual accounts that are linked to each other.

Under Polish law, an agent is a natural person registered in the list of customs agents. Agents must be qualified to undertake the profession; a professional qualification from a course organized by our company may be helpful in obtaining this. Who can become a customs agent?

To become a customs agent, it is necessary to:

  • have full legal capacity
  • possess a qualification or defined experience in border handling of operators, i.e.:
  • a university degree in economic, legal or technical sciences, including knowledge and skills in administrative and financial law, in particular customs law, or a postgraduate certificate in this field, or:
  • At least 3 years’ experience handling customs matters or:
  • a decision on recognition of qualification to practice as a customs agent.

 

Experience can be proven by presenting, for example, a certificate from an employer. Individuals who have completed specialized training at post-secondary schools no more than 5 years before applying for registration as an agent must present a certificate of completion of such training, course or study.

 

Who cannot become a customs agent:

A person convicted by a final judgment of a fiscal offence or an offence against:

  • reliability of documents
  • property
  • commercial, money or securities trading.

Practical and professional customs training

Depending on the situation, a customs agent may be authorized to act on behalf of their client in the form of direct or indirect representation. Direct representation consists of the agent acting for and on behalf of the principal, while an indirect representative performs a legal act for the principal but in their own name.
